All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Netherlands. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Product Terms and Conditions

Personal Training Programmes

As with any personal training programme, there are a set of important terms and conditions of which the client must agree and adhere to. Please read through the following section to understand the terms and conditions of our contractual agreement. These terms and conditions apply for the 6- and 12-week personal training programmes. 

1. Health Screening
A. All clients must complete all required paperwork stated within the Welcome Document before commencing any exercise programme.
B. Josh Thorley may require a letter of ‘medical clearance’ from your GP if your health screening or PAR-Q suggest you have a health complication that may be impaired by exercise. Please be aware that your GP may charge for providing this letter.
C. Josh Thorley cannot be held liable in any way for undeclared or unknown medical conditions.
D. A pre-screening health and fitness assessment will be performed as part of your
personal training programme and must be completed to determine exercise
capability. This assessment is usually performed as the first exercise session
performed between the client and Josh Thorley.
E. If health or fitness circumstances change over the course of the programme, then it is the client’s responsibility to aware Josh Thorley of any change.

2. Cancellation Policy
A. Personal training sessions that are rescheduled or cancelled < 12 hours before the session will result in forfeiture of the session and a loss of the financial investment at the rate of one session.
B. If rescheduling or cancellation continues to incur (at a rate of > 3 reschedules or cancellation for every 1 month) then Josh Thorley reserves the right to cancel your contract by post, email, or telephone. 24 hours after this cancellation has been served, Josh Thorley reserves the right to refund you any unused purchased personal training sessions.
C. Exemptions can be made if reschedule or cancellation are made on a one-time basis, especially if this is due to an emergency beyond your control. It is your responsibility to ensure you contact Josh as soon as possible.
D. In the event whereby Josh Thorley is unable to fulfil the agreed contract with you, a full refund will be served 24 hours following mutual agreement with the client.
E. In the event of a medical emergency whereby you are unable to continue with exercise, it is necessary to gain a medical letter before you receive a full refund on any unused sessions.

3. Lateness Policy
A. Clients arriving late will receive the remaining scheduled session time unless other arrangements have been previously made with Josh. For example, if you are 15 minutes late to your 1-hour personal training session, then you will only receive a 45-minute session.
B. If you are 30 minutes late into your 1-hour personal training session, then the session will be cancelled without reschedule. Full payment of the session will be taken.

4. Contact Information Policy
A. As part of the client’s agreement with Josh Thorley, they will be given his personal and work contact details to communicate effectively with him. It is their responsibility to not pass on his personal information to anyone unless permission from Josh Thorley has been granted.

5. Gym Policy
A. As part of the client’s agreement with Josh Thorley, you shall register independently at the leisure facility at which he is currently employed at.
B. The client should adhere to the terms and conditions of the leisure facility at which they will be performing the personal training programme at.
C. It is the client’s responsibility to become adequately prepared to the gym
environment. Safe and correct equipment and clothing suggestions will be detailed in the welcome document. Failure to be safely prepared for exercise will result in the immediate cancellation of the session without reschedule.
D. Josh Thorley will not accept liability for any damage or loss to a client’s personal property brought into the club’s premises.

Personal Training Session

Health Screening

  3. Josh Thorley cannot be held liable in any way for undeclared or unknown medical conditions.

  4. In the event whereby Josh Thorley is unable to fulfil the agreed contract with you, a full refund will be served 24 hours following mutual agreement with the client unless the client would like to reschedule the session.

  3. It is the client’s responsibility to become adequately prepared to the gym environment. Safe and correct equipment and clothing suggestions will be detailed in the welcome document. Failure to be safely prepared for exercise will result in the immediate cancellation of the session without reschedule.
  4. Josh Thorley will not accept liability for any damage or loss to a client’s personal property brought into the club’s premises.

Health Screening Assessment

Health Screening
A. All clients must complete all relevant fields stated within the Welcome Document before commencing the health screening assessment
B. Josh Thorley may require a letter of ‘medical clearance’ from your GP if your health screening or PAR-Q suggest you have a health complication that may be impaired by exercise. Please be aware that your GP may charge for providing this letter.
C. Josh Thorley cannot be held liable in any way for undeclared or unknown medical conditions.
D. If a health concern becomes evident during or following assessment of the health screening assessment, the client will be referred onto the correct health professional.

Health and Fitness Interpretation
A. All feedback relating to health and fitness provided during and after the health screening assessment by Josh should not be interpreted as medical advice.
B. Josh is not liable for the implementation of strategies by the client to improve certain health outcomes following assessment.

Cancellation Policy
A. Health Screening Assessments that are cancelled < 12 hours before the session will result in forfeiture of the session and a loss of the financial investment at the rate of £50.00.
B. Personal training sessions that are cancelled > 12 hours before the session where the client does not wish to pursue will result in a full refund at the rate of £50.00.
C. Exemptions can be made if reschedule or cancellation are made under uncontrollable circumstances, especially if this is due to an emergency beyond your control. It is your responsibility to ensure you contact Josh as soon as possible.
D. In the event whereby Josh Thorley is unable to fulfil the agreed contract with you, a full refund will be served 24 hours following mutual agreement with the client unless the client would like to reschedule the session.

Lateness Policy

For example, if you are 15 minutes late to your health screening assessment, then you will only receive a limited amount of tests that can be performed safely under the remaining time limit.
B. If you are 30 minutes late into your 1-hour personal training session, then the session will be cancelled without reschedule. Full payment of the session will be taken. It is important for the client to understand the scale of planning which enters each session plan and therefore this should be accounted for through full payment even when the client breaks the lateness policy.
